1. Introduction and Acceptance of Terms

Welcome to GetMapSprint! These Terms of Service ("Terms") govern your access to and use of the GetMapSprint website, located at https://getmapsprint.com, and all related services, features, content, and applications offered by GetMapSprint (collectively, the "Service"). When we say "we," "us," or "our," we mean GetMapSprint. When we say "you" or "your," we mean the individual or entity accessing or using the Service.

Please read these Terms carefully. They form a legally binding agreement between you and GetMapSprint. By accessing or using any part of the Service, you agree to be bound by these Terms. If you don't agree to all the terms and conditions of this agreement, then you may not access the Service or use any services. Your agreement to these Terms also signifies your understanding of our Privacy Policy, which explains how we collect, use, and disclose your information.

2. Account Creation and Security

2.1. Account Registration

To access certain features of the GetMapSprint Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to keep your account information updated. You can't use a username that is offensive, infringes on anyone's rights, or is misleading.

2.2. Account Responsibilities

You are solely responsible for maintaining the confidentiality of your account password. You are also responsible for all activities that occur under your account, whether or not you authorized them. You must notify GetMapSprint immediately of any unauthorized use of your account or any other breach of security. We won't be liable for any loss or damage arising from your failure to comply with this section.

2.3. Eligibility

You must be at least 18 years old to create an account and use the GetMapSprint Service. By creating an account, you represent and warrant that you meet this age requirement.

3. Use of the Service

3.1. License to Use

Subject to your compliance with these Terms, GetMapSprint grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business or personal purposes, as applicable. This license is for the sole purpose of enabling you to use and enjoy the benefit of the Service as provided by GetMapSprint, in the manner permitted by these Terms.

3.2. Prohibited Uses

You agree not to use the GetMapSprint Service for any purpose that is unlawful or prohibited by these Terms. This includes, but isn't limited to:

  • Violating any applicable local, state, national, or international law or regulation.
  • Infringing upon or violating our intellectual property rights or the intellectual property rights of others.
  • Harassing, abusing, insulting, harming, defaming, slandering, disparaging, intimidating, or discriminating based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability.
  • Submitting false or misleading information.
  • Uploading or transmitting viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service or of any related website, other websites, or the Internet.
  • Collecting or tracking the personal information of others.
  • Spamming, phishing, pharming, pretexting, spidering, crawling, or scraping.
  • Interfering with or circumventing the security features of the Service or any related website, other websites, or the Internet.
  • Attempting to reverse engineer, decompile, or disassemble any software used to provide the Service.

If you engage in any of these activities, we may suspend or terminate your account immediately.

4. User-Generated Content (UGC)

4.1. Your Content

The GetMapSprint Service allows you to create, upload, post, link, store, share, and otherwise make available certain information, text, graphics, videos, or other material ("User Content"). This might include Google Business Profile posts, business content, and post approvals. You retain all ownership rights in your User Content. We don't claim any ownership over your User Content.

4.2. License to GetMapSprint

By making your User Content available on or through the Service, you grant GetMapSprint a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, publicly perform, and publicly display your User Content in connection with operating and providing the Service. This license is necessary for us to, for example, display your Google Business Profile posts and business content, or process your post approvals. It also allows us to improve the Service.

4.3. Your Responsibilities for UGC

You are solely responsible for your User Content and the consequences of posting or publishing it. You represent and warrant that:

  • You own or have the necessary licenses, rights, consents, and permissions to use and authorize GetMapSprint to use all patent, trademark, trade secret, copyright, or other proprietary rights in and to any and all User Content to enable inclusion and use of the User Content in the manner contemplated by the Service and these Terms.
  • Your User Content does not violate any law or infringe upon the rights of any third party, including copyright, trademark, privacy, publicity, or other personal or proprietary rights.
  • Your User Content does not contain any defamatory, libelous, hateful, violent, obscene, pornographic, unlawful, or otherwise offensive material.

We reserve the right (but have no obligation) to remove or modify any User Content for any reason, including User Content that we believe violates these Terms.

5. AI-Generated Content

The GetMapSprint Service incorporates artificial intelligence (AI) to generate certain content, such as AI-generated Google Business Profile posts, business descriptions, and service content. This AI-generated content is provided as part of the Service. While we strive for accuracy and utility, AI models can sometimes produce unexpected or incorrect results. You acknowledge and agree that:

  • GetMapSprint does not guarantee the accuracy, completeness, or reliability of any AI-generated content.
  • You are responsible for reviewing and verifying any AI-generated content before relying on it for any purpose. For instance, if the AI suggests a particular Google Business Profile post, you should review it for accuracy before publishing.
  • AI-generated content may reflect biases present in the data it was trained on or may not always align with your specific intent.
  • The use of AI-generated content is at your own risk.

We are continuously working to improve our AI models, but we cannot be held responsible for any decisions or actions taken based solely on AI-generated content from the Service.

6. Intellectual Property Rights

6.1. GetMapSprint's Property

The Service and its original content (excluding User Content and AI-generated content, which have specific provisions), features, and functionality are and will remain the exclusive property of GetMapSprint and its licensors. This includes all software, designs, text, graphics, images, and other elements of the https://getmapsprint.com website. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of GetMapSprint.

6.2. Feedback

If you provide us with any feedback, suggestions, or ideas regarding the Service ("Feedback"), you grant GetMapSprint a worldwide, perpetual, irrevocable, royalty-free license to use and incorporate such Feedback into the Service or any other products or services, without any obligation to you.

7. Third-Party Services and Data Sharing

The GetMapSprint Service may integrate with or contain links to third-party websites, services, or applications that are not owned or controlled by GetMapSprint. For example, we might use third-party analytics tools to understand how users interact with our map creation features, or integrate with advertising platforms to display relevant ads. We also use third-party cloud providers to host our infrastructure.

You acknowledge and agree that GetMapSprint has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. We don't endorse or make any representations about them. You access and use these third-party services at your own risk. We strongly advise you to read the terms and conditions and privacy policies of any third-party websites or services that you visit.

By using the Service, you consent to GetMapSprint sharing certain data with these third-party services as described in our Privacy Policy. This data sharing is often necessary for the functionality of the Service (e.g., processing payments, hosting data) or for improving our services (e.g., analytics).

8. Fees and Payment

Certain features of the GetMapSprint Service may be offered on a subscription or paid basis. If you choose to subscribe to or purchase such features, you agree to pay all applicable fees as described on the https://getmapsprint.com website. All fees are stated in U.S. Dollars unless otherwise specified. You authorize GetMapSprint to charge your chosen payment method for all applicable fees. All payments are non-refundable unless otherwise stated in writing by GetMapSprint. We reserve the right to change our prices at any time, but we'll provide you with reasonable notice before any price changes take effect.

9. Account Termination and Data Deletion

9.1. Account Termination

You may terminate your account at any time by contacting hello@getmapsprint.com or by deleting your account in Settings. Upon termination, we will delete your personal data within 30 days, except where retention is required by law.

9.2. Data Deletion

You can request immediate deletion of all your data, including Google Business Profile connection data, by contacting hello@getmapsprint.com. We will confirm deletion within 7 business days.

10. Disclaimers

YOUR USE OF THE GETMAPSPRINT SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. GETMAPSPRINT EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE MAKE NO WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. WE ALSO MAKE NO WARRANTY THAT THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE, OR THAT THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL OBTAINED BY YOU THROUGH THE SERVICE WILL MEET YOUR EXPECTATIONS. ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SERVICE IS DONE AT YOUR OWN DISCRETION AND RISK, AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF ANY SUCH MATERIAL.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GETMAPSPRINT, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, THAT RESULT FROM THE USE OF, OR INABILITY TO USE, THE SERVICE. THIS LIMITATION APPLIES WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER BASIS, EVEN IF GETMAPSPRINT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. IN NO EVENT SHALL GETMAPSPRINT'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AMOUNT PAID BY YOU TO GETMAPSPRINT FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED U.S. DOLLARS ($100.00) IF YOU HAVE NOT HAD ANY PAYMENT OBLIGATIONS TO GETMAPSPRINT, WHICHEVER IS GREATER. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

11. Indemnification

You agree to defend, indemnify, and hold harmless GetMapSprint and its licensees and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of:

  • Your use and access of the Service, including any data or content transmitted or received by you.
  • Your breach of any of these Terms.
  • Your violation of any third-party rights, including without limitation any right of privacy or intellectual property rights.
  • Your violation of any applicable law, rule, or regulation.
  • Any claim or damages that arise as a result of any of your User Content or any content submitted via your account.

This means if someone sues us because of something you did on our site (like uploading infringing content), you'll cover our legal costs and any damages we have to pay.

12. Termination

12.1. By You

You may stop using the GetMapSprint Service at any time. If you wish to terminate your account, you can do so through your account settings or by contacting us at hello@getmapsprint.com.

12.2. By GetMapSprint

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms. For example, if you repeatedly violate our content policies or engage in fraudulent activity, we might terminate your account.

12.3. Effect of Termination

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

13. Governing Law and Dispute Resolution

13.1. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. This means that any legal questions about these Terms will be decided under U.S. law.

13.2. Arbitration

Any dispute, controversy, or claim arising out of or relating to these Terms or the breach, termination, or validity thereof, shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") in accordance with its Commercial Arbitration Rules. The arbitration shall take place in Lake Elsinore, California, United States. The decision of the arbitrator shall be final and binding upon both parties. You agree that any arbitration will be conducted on an individual basis and not in a class, consolidated, or representative action.

13.3. Exceptions to Arbitration

Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party's copyrights, trademarks, trade secrets, patents, or other intellectual property rights.

14. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. For instance, a change to how we handle your User Content would be considered material. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.

15. Miscellaneous

15.1. Entire Agreement

These Terms, together with the Privacy Policy and any other legal notices published by GetMapSprint on the Service, constitute the entire agreement between you and GetMapSprint concerning the Service.

15.2. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. The invalid or unenforceable provision will be replaced by a valid, enforceable provision that most closely matches the intent of the original provision.

15.3. Waiver

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and GetMapSprint's failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

15.4. Assignment

You may not assign any of your rights or obligations under these Terms without our prior written consent. GetMapSprint may assign its rights and obligations under these Terms to any party at any time without notice to you.

16. Beta Disclaimer

GetMapSprint is currently in beta. Features, pricing, and terms may change during the beta period. Beta users may have access to features that are still being tested and may contain bugs. By using the Service during beta, you acknowledge that the Service is still under development and that your experience may not reflect the final product.

17. Google Services and API Compliance

By connecting your Google Business Profile to GetMapSprint, you agree to comply with Google's Terms of Service (https://policies.google.com/terms) and the Google Business Profile Acceptable Use Policy. You acknowledge that GetMapSprint accesses your Google Business Profile data via Google APIs solely to provide the Service (e.g., reading reviews, drafting posts, and publishing approved content). You are strictly prohibited from using GetMapSprint to generate or post spam, fake reviews, misleading content, or to otherwise violate Google's policies. GetMapSprint reserves the right to suspend or terminate your access immediately if we detect or are notified of any violation of Google's policies.
